Terms and Conditions for the Benetics Referral Program

1. General Provisions
The “Benetics Referral Program” (“Program”) allows active customers of Benetics (“Referrer”) to receive a tiered reward (“Reward”) by referring new customers (“New Customers”). By participating in the Program, the Referrer accepts the following terms and conditions.
2. Eligibility
Participation is exclusively available to Benetics customers with an active, paid annual subscription that has not been canceled. Customers with only a trial account are excluded from participation. Employees of Benetics, their relatives, and Benetics’ partners and affiliates are also excluded from the Program. The New Customer must be a distinct individual or legal entity from the Referrer. The Referrer must not act as the New Customer’s representative and must register via the referral link on the Benetics website for contact by Benetics.
3. Definition of New Customer
A New Customer is defined as someone who has not previously purchased a paid annual package from Benetics or received an offer from Benetics. The New Customer must sign an annual Benetics contract within three months of the referral to qualify for a reward. Contracts with durations of less than 12 months are excluded from the Reward.
4. Reward Tiers and CalculationThe Reward is determined by the total number of licenses purchased by the New Customer within 12 months of signing their first annual contract:
– Under 5 licenses: no reward (Tier 1)
– 6–20 licenses: 300 CHF/EUR/USD (Tier 2)
– Over 20 licenses: 600 CHF/EUR/USD (Tier 3).
The Reward currency matches the currency of the New Customer’s Benetics annual contract.
Additional Regulations: The Reward is calculated based on the initial number of licenses at the time of the first annual contract. If the New Customer purchases additional licenses within the first 12 months of the initial contract, the Reward will be adjusted to the achieved tier.
– Example 1: If the New Customer initially purchases 4 licenses (Tier 0) and increases this to 25 licenses (Tier 3) after 7 months, a Reward of 600 will be granted.
– Example 2: If the New Customer initially purchases 10 licenses (Tier 2) and adds 20 more licenses (total 30) after 4 months, the Referrer will initially receive 300 and later an additional 300 as the difference to Tier 3.
5. Reward Conditions
The Reward is granted only for a successfully completed annual contract with payment confirmation, where the New Customer registered with Benetics via the Referrer’s unique referral link before signing the contract. In cases of multiple referrals and/or registrations for the same New Customer via referral links, the Reward will be credited solely to the first Referrer responsible for the New Customer’s registration with Benetics. The Reward is paid via bank transfer, PayPal, credit card, or TWINT, as designated by the Referrer. Cash payments are excluded.
6. Responsibilities of the Referrer
The Referrer must ensure compliance with all legal requirements, particularly regarding data protection and anti-corruption regulations. Sending mass emails (SPAM) is explicitly prohibited.
7. Exclusion of Participants
Benetics reserves the right to exclude participants from the Program if the Referrer violates these terms and conditions, the referral is deemed unfair, misleading, or aggressive, or the contract with the New Customer is declined for other reasons.
8. Changes and Termination of the Program
Benetics reserves the right to modify, suspend, or terminate the Program at any time without prior notice. Rewards already triggered will remain unaffected.
9. Miscellaneous
These terms and conditions are governed by Swiss law with jurisdiction in Zurich. If any provision of these terms is deemed invalid, the validity of the remaining provisions remains unaffected.
